Welcome to ClarityOps.ai! These Terms of Use ("Terms") govern your access to and use of the ClarityOps.ai website, services, and applications (collectively, the "Service"). Please read these Terms carefully.

By creating an account, connecting an integration, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

2. Description of Service

ClarityOps.ai is an autonomous operations co-pilot designed for individuals and teams. The Service connects to your work tools, ingests contributions and activity, uses artificial intelligence (AI) to analyze and categorize this data, and generates insights, reports, and dashboards to help you track progress, align with goals, and articulate your impact.

3. User Accounts and Responsibilities

• Account Creation: You must provide accurate and complete information when creating your account. You are responsible for safeguarding your password and for all activities that occur under your account.
• Roles: The Service provides for different user roles (e.g., "User," "Manager," "Admin"). You are responsible for managing the roles and permissions of users within your organization's workspace.
• Your Content: You are responsible for all data, text, and other materials that you upload, post, or otherwise transmit to the Service ("User Content").

4. User Content and Data

You retain full ownership of your User Content. By using the Service, you grant ClarityOps.ai a worldwide, non-exclusive, royalty-free license to use, process, reproduce, and display your User Content solely for the purpose of providing, maintaining, and improving the Service for you. This includes, but is not limited to:

• Analyzing your User Content with third-party AI models to generate summaries, categories, impact scores, and other insights.
• Aggregating your User Content to generate team and organizational reports and dashboards.

5. Third-Party Integrations

The Service allows you to connect third-party accounts, such as Notion, Google, Slack, Linear, and GitHub ("Third-Party Integrations").

• Authorization: By connecting a Third-Party Integration, you grant ClarityOps.ai permission to access and process data from that account as permitted by the third party's API and your permissions settings.
• Data Handling: We will handle data obtained from Third-Party Integrations in accordance with our Privacy Policy.
• No Endorsement: ClarityOps.ai is not responsible for the data, products, or services of these third parties. Your use of any Third-Party Integration is subject to their respective terms and policies.

6. Fees and Payment

Certain features of the Service may require payment. You agree to pay all applicable fees for the service tier you select. All fees are non-refundable, except as required by law.

7. Acceptable Use Policy

You agree not to misuse the Service. For example, you must not:

• Upload or transmit any content that is unlawful, harmful, or infringes on the rights of others.
• Submit sensitive personal information, such as health information, financial data, or government-issued identification numbers.
• Attempt to disrupt or gain unauthorized access to the Service or its related systems.

8. Termination

You can stop using our Service at any time. We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms.

9. Disclaimers and Limitation of Liability

The Service is provided "AS IS." To the fullest extent permitted by law, ClarityOps.ai makes no warranties, either express or implied, about the Service. ClarityOps.ai will not be liable for any indirect, special, incidental, consequential, or exemplary damages arising out of the use of the Service.

These Terms will be governed by the laws of the United States, without regard to its conflict of laws principles.
